We are requesting a zoning by-law amendment to allow changes with respect to the street facing facade at the ground floor in order to alllow this design solution that is fine tuned to this business model. The proposed design meets the intent of these by-law clauses. It is subject to interpretation whether they meet the by-law requirements in full. With respect to the rear hard setback, the variance would allow this new restaurant and these residential untos to be contructed with a rear setback that is in keepin gwith the existing rear context,
