PURPOSE OF THE APPLICATION: The Owners want to demolish their existing dwelling and construct a new two-storey detached dwelling with a 1.5 car attached garage at the basement level, as shown on plans filed with the Committee. RELIEF REQUIRED: In order to proceed, the Owners require the Authority of the Committee for Minor Variances from the Zoning By-law as follows: Under By-law 2008-250 (a)
To permit an increase in the building height to 8.78 metres whereas the By-law permits a maximum building height of 8.0 metres.
(b)
To permit the proposed front step to project 3.67 metres into the required front yard setback whereas the By-law permits a maximum projection of 1.5 metres into a required front yard.
(c)
To permit the proposed covered balcony to project 3.55 metres into the required rear yard setback whereas the By-law permits a maximum projection of 2.0 metres into a required rear yard.
Under Zoning By-law Amendment 2015-228 (Infill Development Regulations – Phase II) (d)
To permit a reduced rear yard setback of 7.6 metres whereas the By-law requires that lots with a depth greater than 30 metres but less than 45 metres have a minimum rear yard setback which is the greater of the building height or the lot depth minus 22.5 metres. In this case, the building height of 8.78 metres is the greater.
THE APPLICATION indicates that the Property is not the subject of any other current application under the Planning Act.
