PURPOSE OF THE APPLICATION:
At its Hearing on October 17, 2012, the Committee granted Minor Variance Application (D08-0212/A-00326) to permit a reduced lot width, lot area and lot coverage for the creation of this
property, subject to the proposed construction being in accordance with plans filed. The new
Owners have revised the plans and want to construct a different two-storey detached dwelling,
as shown on plans filed with the Committee.
In order to proceed, the Owners require the authority of the Committee for Minor Variances from
the Zoning By-law as follows:
Under By-law 2008-250 (previously approved)
To permit a reduced lot width of 10.69 metres whereas the By-law requires
minimum lot width of 19.5 metres.
To permit a reduced lot area of 485.9 square metres whereas the By-law requires
a minimum lot area of 600 square metres.
To permit an increase in the lot coverage of 37.27% (181.09 square metres)
whereas the By-law permits a minimum lot coverage of 35% (170.06 square
Under Zoning By-law Amendment 2015-228 (Infill Development Regulations – Phase II)
To permit a reduced rear yard setback of 13.77 metres whereas the By-law states
that on lots greater than 45 metres, the rear yard setback must be equal to 50% of
the lot depth. In this case 50% of the lot depth of 45.43 metres requires a
minimum rear yard setback 22.71 metres.
THE APPLICATION indicates that the Property is not the subject of any other current
application under the Planning Act.
