PURPOSE OF THE APPLICATION:
In August 2013, the Committee refused a Minor Variance application to establish an
outdoor seasonal patio for the existing restaurant located on the property.
The Owners are re-applying to the Committee to establish an outdoor seasonal patio,
with seating for approximately 32 people at the front and west side of the building, as well
as construct an acoustic barrier, two metres in height, which would be constructed at the
rear of the patio, all as shown on plans filed with the Committee. As the existing
restaurant occupies 28.92 square metres of floor area in the basement, relief from the
parking requirements is also being requested.
RELIEF REQUIRED:
In order to proceed, the Owners require the Authority of the Committee for Minor
Variances from the Zoning By-law as follows:
a) To permit an outdoor commercial patio to be located 25 metres from a residential

zone to the north whereas the By-law states that an outdoor commercial patio is
prohibited in any yard facing or abutting a residential zone or abutting a yard or
lane facing or abutting a residential zone unless it is located a minimum of 30
metres from the residential zone.
b) To permit 0 parking spaces to be provided for the first 150 square metres of a

restaurant use located on the ground floor and the basement level of a building in
the TM Zone whereas the Bylaw requires 0 parking spaces to be provided for the
first 150 square metres of a restaurant use located on the ground floor of a
building; three parking spaces for the next 50 square metres over 150 square
metres; or for any restaurant space not located on the ground floor of a building.
THE APPLICATION indicates that the Property is not the subject of any other current
application under the Planning Act.
