PURPOSE OF THE APPLICATION: At its Hearing on October 20, 2010, the Committee granted Minor Variance Application (D08-0210/A-00300) to permit a reduced lot width pertaining to the property subject to the proposed construction being in accordance with plans filed. The Owners have now revised their plans and want to construct a two-storey detached dwelling with an attached garage, as shown on plans filed with the Committee. RELIEF REQUIRED: In order to proceed the Owners require the Authority of the Committee for Minor Variances from the Zoning By-law as follows: Under By-law 2008-250 (a)
To permit a reduced lot width of 18.54 metres whereas the By-law requires a minimum lot width of 19.5 metres.
Under Zoning By-law Amendment 2015-228 (Infill Development Regulations – Phase II) New (b)
To permit a reduced rear yard setback of 9.59 metres whereas the By-law requires that lots with a depth greater than 30 metres but less than 45 metres have a minimum rear yard setback which is the greater of the Building height or the lot depth minus 22.5 metres. In this case, the minimum rear yard setback is 10.49 metres which represents the lot depth of 33.0 metres minus 22.5 metres.
THE APPLICATION indicates that the Property is not the subject of any other current application under the Planning Act.
