PURPOSE OF THE APPLICATIONS:
In 2013, the Committee granted Consent Applications (D08-01-13/B-00399 & D08-01-13/B00400) which were not completed within the required statutory time period. The Owner has now
submitted Consent Applications (D08-01-5/B-00370 & D08-01-15/B-00371) which, if approved
will have the effect of creating two separate parcels of land. Both parcels as well as the
proposed development on each parcel will not be in conformity with the requirements of the
Zoning By-law. The Owner wants demolish the existing dwelling and construct a two-storey
semi-detached dwelling with one unit on each of the newly created parcels, as shown on plans
filed with the Committee.
RELIEF REQUIRED:
In order to proceed, the Owner requires the Authority of the Committee for Minor Variances from
the Zoning By-law as follows:
A-00346: 870 Norton Avenue, Part 1 on a Draft 4R-Plan submitted with the applications, one
unit of a semi-detached dwelling.
Under By-law 2008-250
(a)

To permit a reduced lot width of 6.69 metres whereas the By-law requires a
minimum lot width of 7.5 metres.

(b)

To permit a reduced lot area of 203.9 square metres whereas the By-law requires
a minimum lot area of 225 square metres.

(c)

To permit an increase in the building height to 8.52 metres above the existing
average grade whereas the By-law permits a maximum building height of 8.0
metres.

Under Zoning By-law Amendment 2015-228 (Infill Development Regulations – Phase II)
(d)

To permit a reduced rear yard setback of 7.54 metres whereas the By-law requires
the rear yard setback to be the greater of either the height of the building above
the existing average grade or a distance equal to the lot depth minus 22.5 metres


on lots greater than 30 metres but less than 45 metres deep, in this case the
building height of 8.52 metres above the existing grade is the greater.

Under By-law 2008-250
(e)

To permit a reduced westerly corner side yard setback of 3.0 metres whereas the
By-law requires a minimum corner side yard setback of 4.5 metres (Elmhurst
Street).

(f)

To permit an increase in the building height to 8.52 metres above the existing
average grade whereas the By-law permits a maximum building height of 8.0
metres.

(g)

To permit a porch to project 3.02 metres into the westerly corner side yard setback
whereas the By-law permits a maximum projection of 2.0 metres into a required
yard but no closer than 1 metre to a property line.

Under Zoning By-law Amendment 2015-228 (Infill Development Regulations – Phase II)
(h)

To permit a reduced rear yard setback of 7.52 metres whereas the By-law requires
the rear yard setback to be the greater of either the height of the building above
the existing average grade or a distance equal to the lot depth minus 22.5 metres
on lots greater than 30 metres but less than 45 metres deep, in this case the
building height of 8.52 metres above the existing grade is the greater.

THE APPLICATIONS indicate that the Property is the subject of current consent applications as
noted above under the Planning Act.
