PURPOSE OF THE APPLICATIONS:
The Owner has filed Consent Applications (D08-01-15/B-00367 to D08-01-15/B-00369, which, if
approved, will have the effect of creating three separate parcels of land. The Owner wants to
demolish the existing dwelling and shed and construct a two-storey, three-door townhouse
dwelling, as shown on plans filed with the Committee.
RELIEF REQUIRED:
In order to proceed, the Owner requires the Authority of the Committee for Minor Variances from
the Zoning By-law as follows:
A-00343: 300A Richelieu Avenue, Part 1 & 2 on a draft 4R-Plan filed with the application, one
unit of the townhouse dwelling
Under Zoning By-law Amendment 2015-228 (Infill Development Regulations – Phase II)
(a)

To permit a reduced rear yard setback of 6.10 metres whereas the By-law requires
that the minimum rear yard setback for lots with a depth greater than 20 metres but
less than 30 metres deep to be the greater of either the height of the building
above existing average grade, or a distance equal to 25% of the lot depth. In this
case the minimum rear yard setback is 8.0 metres which represents the building
height above the existing average grade.

A-00344: 300B Richelieu Avenue, Part 3 on the plan submitted, one unit of teh townhouse
dwelling.
Under By-law 2008-250
(b)

To permit a reduced lat area of 154.8 square metres whereas the By-law requires
a minimum lot area of 180.0 square metres.


Under Zoning By-law Amendment 2015-228 (Infill Development Regulations – Phase II)
(c)

To permit a reduced rear yard setback of 6.13 metres whereas the By-law requires
that the minimum rear yard setback for lots with a depth greater than 20 metres but
less than 30 metres deep to be the greater of either the height of the building
above existing average grade, or a distance equal 25% of the lot depth. In this
case the minimum rear yard setback is 8.0 metres which represents the building
height above the existing average grade.

A-00345: 300C Richelieu Avenue, Part 4 on the plan submitted, one unit of a townhouse
dwelling.

case the minimum rear yard setback is 8.0 metres which represents the building
height above the existing average grade.

THE APPLICATIONS indicate that the Property is the subject of current consent applications as
noted above under the Planning Act.
