PURPOSE OF THE APPLICATION:
The Owner wants to construct six, three and one half-storey staked townhouse dwellings
containing 64 units as part of a Planned Unit Development (PUD), as shown on plans filed with
In order to do this, the Owner requires the Authority of the Committee for Minor Variances from
the Zoning By-law as follows:
To permit a reduced parking space rate of 1.1 spaces per dwelling unit, or 71
parking spaces whereas the By-law requires a minimum of 1.2 parking spaces per
dwelling unit, in this case 77 parking spaces.
To permit a reduced rear yard setback of 4.5 metres (Tenth Line Road) whereas
the By-law requires a minimum rear yard setback of 6.0 metres.
To permit a reduced southerly side yard setback of 5.0 metres after the first 21
metres back from the front lot line whereas the By-law requires minimum side yard
setback of 6.0 metres, after the first 21 metres from the front lot line.
To permit two parking spaces to be located in the northerly side yard (promenade
Décoeur Drive) whereas the By-law does not permit parking in a required and
provided front or side yard.
It should be noted, that for By-law purposes, Magnolia Street is deemed to be the front lot line
for this property.
THE APPLICATION indicates that the Property is the subject of a current Site Plan Control
application (D07-12-15-0095) under the Planning Act.
