PURPOSE OF THE APPLICATION:
At its Hearing on July 2, 2014 the Committee granted a Minor Variance Application (D08-0214/A-00193) pertaining to this property, subject to the proposed construction being in
accordance with plans filed. The Owners have now filed revised plans to construct a 6.03 m x
11.95 m, one-storey addition which will include an attached garage and entranceway on the
south-west corner of their existing dwelling, as shown on plans filed with the Committee. The
existing shed located on the west side of the property is to be demolished.
In order to proceed, the Owners require the Authority of the Committee for Minor Variances from
the Zoning By-law as follows:
Under By-law 2008-250
a) To permit a reduced total combined interior side yard setback of 2.21 metres, with one
minimum yard of 0.64 metres (existing) and a proposed westerly side yard setback of
1.57 metres, whereas the By-law requires a minimum total combined interior side yard
setback of 3.0 meters, with one minimum yard no less than 1.2 metres.
Under Zoning By-law Amendment 2015-228 (Infill Development Regulations – Phase II)
b) To permit a reduced rear yard setback of 11.02 metres whereas the By-law requires the
minimum rear yard setback on lots greater than 30 metres but less than 45 metres deep
to be the greater of either the height of the building above existing average grade, or a
distance equal to the lot depth minus 22.5 metres. In this case the lot depth of 36.58
metres minus 22.5 metres equals 14.089 metres, which is greater that the building height.
THE APPLICATION indicates that the Property is not the subject of any other current
application under the Planning Act.
