PURPOSE OF THE APPLICATION:
The Owner wants to demolish his existing carport and proposes to construct a 4.57 m x 10.36
m, two-storey addition consisting of a one-car garage on the ground floor with a loft above on
the north side of the existing dwelling, as shown on plans filed with the Committee.
In order to proceed, the Owner requires the Authority of the Committee for Minor Variances from
the Zoning By-law as follows:
Under By-law 2008-250
a) To permit a reduced front yard setback (east side) of 5.18 metres whereas the By-law
requires a minimum front yard setback of 7.5 metres.
b) To permit a reduced rear yard setback of 4.98 metres whereas the By-law requires a
minimum rear yard setback of 9.0 metres.
Under Zoning By-law Amendment 2015-228 (Infill Development Regulations – Phase II)
c) To permit a reduced rear yard setback of 4.98 metres, whereas the By-law requires that lots
with a depth greater than 20 metres but less than 30 metres have a minimum rear yard
setback which is greater than the building height or a distance equal to 25 percent of the lot
depth which must comprise at least 25 percent of the lot area of the lot. In this case the
minimum rear yard setback is the height of the building for a total of 6.5 metres.
It should be noted, that for By-law purposes, the easterly portion of Fairhill Crescent is deemed
to be the front lot line for this property.
THE APPLICATION indicates that the Property is not the subject of any other current
application under the Planning Act.
