PURPOSE OF THE APPLICATION:
In 2009, the Committee granted Minor Variance Application (D08-02-09/A-00121) for the
construction of a one-storey addition on the west side of the existing two-storey dwelling. The
Owner has changed his plans and wants to renovate his dwelling which will include constructing
the previously approved one-storey addition on the west side of the dwelling along with a 4.1 m
x 3.3 m partial second storey above, a 2.74 m x 3.42 m, two-storey addition at the rear of the
dwelling and a new 1.8 m x 3.7 m entrance canopy on the west side of the dwelling as well as
enclosing the existing front entrance, all as shown on plans filed with the Committee.
RELIEF REQUIRED:
In order to proceed, the Owner requires the Authority of the Committee for Minor Variances from
the Zoning By-law as follows:
Under By-law 2008-250
a)

To permit a reduced corner side yard setback of 3.5 metres (Sieveright Road)
whereas the By-law requires a minimum corner side yard setback of 4.5 metres.

Under Zoning By-law Amendment 2015-228 (Infill Development Regulations – Phase II)
b)

To permit a reduced rear yard setback of 7.34 metres whereas the By-law requires that
lots with a depth greater than 30 metres but less than 45 metres
have a minimum rear
yard setback of the lot depth minus 22.5 metres. In this
case, the minimum rear
yard setback is 14.24 metres which represents the lot depth of 36.74 metres minus 22.5
metres.

It should be noted that for By-law purposes, Monet Court is deemed to be the front lot line for
this property.
THE APPLICATION indicates that the Property is not the subject of any other current
application under the Planning Act.
