MINOR VARIANCE/PERMISSION APPLICATION

PURPOSE OF THE APPLICATION:
At its Hearing in March of 2015, the Committee of Adjustment approved Minor Variance
Application (D08-02-15/A-00051) for the construction of a three-storey, three-unit
dwelling. The existing two-storey, two-unit dwelling is to be demolished. The Owner has
now made revisions to the proposed dwelling, as shown on plans filed with the
In order to proceed, the Owner requires the Authority of the Committee for Minor
Variances from the Zoning By-law as follows:
a) To permit a reduced lot width of 10.04 metres whereas the By-law requires a
minimum lot width of 11 metres.
b) To permit a reduced lot area of 302.9 square metres whereas the By-law
requires a minimum lot area of 360 square metres.
c) To permit a reduced driveway width of 2.7 metres whereas the By-law requires a
driveway that provides access to parking spaces to have a minimum width of 3
d) To permit a reduced northerly interior side yard setback of 0.61 metres whereas
the By-law requires a minimum interior side yard of 1.2 metres.
e) To permit a balcony to project 2.3 metres into the rear yard whereas the By-law
permits a balcony to project 2 metres into the rear yard, but no closer than 1
metre to a lot line.
f) To permit an open stairway to project 4.8 metres into the rear yard whereas the
By-law permits an open stairway to project 1.5 metres into the rear yard, but no
closer than 1 metre to a lot line.
THE APPLICATION indicates that the Property is not the subject of any other current
application under the Planning Act.
