PURPOSE OF THE APPLICATION:
The Owners want to construct an open covered porch with steps and a landing
measuring 9.5 m x 1.53 m on the west side of their existing dwelling as well as construct
a 12.1 m x 4.06 m canopy over an existing patio at the rear of the dwelling, as shown on
plans filed with the Committee. It is proposed to screen in a 7.32 m x 4.06 m portion of
the canopy area.
RELIEF REQUIRED:
In order to proceed, the Owners require the Authority of the Committee for Minor
Variances from the Zoning By-law as follows:
a) To permit a permitted projection (the proposed covered porch and steps on the
west side as well as a portion of the rear canopy structure) to project 1.53 metres
into the westerly side yard and to within 0.03 metres of the westerly lot line
whereas the By-law permits a maximum permitted projection of 2.0 metres into a
required yard, but no closer than 1.0 metre to a lot line.
b) To permit the proposed covered porch and steps as well as a portion of the rear
canopy structure to be located in the westerly side yard whereas under the
Heritage Overlay provisions of the By-law, projections are not permitted into the
front, corner side yard or side yard.
c) To permit an easterly side yard setback of 1.68 metres for the rear screened-in
canopy structure including the eaves whereas under the Heritage Overlay
provisions of the By-law, the side yard setback of an addition must be at least 0.6
metres greater than that of the existing wall of the building which, in this case,
would be 2.54 metres.
d) To permit the rear screened-in canopy structure including the eaves to be located
in the easterly side yard whereas under the Heritage Overlay provisions of the Bylaw, projections are not permitted into the front, corner side yard or side yard.
THE APPLICATION indicates that the Property is not the subject of any other current
application under the Planning Act.
