PURPOSE OF THE APPLICATION:
The Owners want to convert their detached dwelling to a three-unit dwelling. Interior
renovations and additions to the garage at the rear are proposed, as shown on plans
filed with the Committee.
RELIEF REQUIRED:
In order to proceed, the Owners require the Authority of the Committee for Minor
Variances from the Zoning By-law as follows:
Under By-law 2008-250
a) To permit a reduced total amenity area of 24.6 square metres for the proposed
three-unit dwelling whereas the By-law requires a minimum total amenity area of
45 square metres and requires 100% of the required amenity area to be
communal amenity area which must be located at grade in the rear yard, be
landscaped, consist of at least 80% soft landscaping and must abut the rear lot
line.
b) To permit a reduced southerly rear yard setback of 7.12% of the lot depth or 2.17
metres whereas the By-law requires a minimum rear yard setback of 25% of the
lot depth or, in this case, 7.5 metres.
c) To permit a reduced rear yard area of 6.7% of the lot area or 24.62 square
metres whereas the By-law requires a minimum rear yard area of 25% of the lot
area or, in this case, 101.63 square metres.
d) To permit a reduced easterly corner side yard setback of 0 metres (Monk Street)
whereas the By-law requires a minimum corner side yard setback of 3.0 metres.


Under Zoning By-law Amendment 2015-228 (Infill Development Regulations – Phase II)
e) To permit a reduced southerly rear yard setback of 2.17 metres whereas the Bylaw states that lots with a depth greater than 30 metres but less than 45 metres
have a minimum rear yard setback which is the greater of the building height or
the lot depth minus 22.5 metres. In this case, the minimum rear yard setback is
8.96 metres, which is the distance equal to the height of the building above
existing average grade.
It should be noted that, for By-law purposes, the frontage on Woodlawn Avenue is
deemed to be the front lot line for this property.
THE APPLICATION indicates that the Property is not the subject of any other current
application under the Planning Act.
