PURPOSE OF THE APPLICATION:
The subject property contains a two-level, five-unit commercial building along with nine
parking spaces located at the rear of the building. Three of the five units are currently
occupied, being a hair salon on the upper level and two restaurants on the lower level.
The Owners want to establish a restaurant and retail store on the upper level, as shown
on plans filed with the Committee.
RELIEF REQUIRED:
In order to proceed, the Owners require the Authority of the Committee for Minor
Variances from the Zoning By-law as follows:
a) To permit restaurant as a permitted use on the ground floor (lower level) and on

the first floor (upper level) whereas the By-law states that for lots fronting on
Elgin Street, restaurants may only be located on the ground floor.

b) To permit 3 parking spaces (0 spaces for the first 150 square metres of gross

floor area, 1 space for the next 50 square metres of gross floor area over 150
square metres and 3.5 spaces per 100 square metres of gross floor area over
200 square metres) for restaurant use on the lower level whereas the By-law
requires a minimum of 8 parking spaces (0 spaces for the first 150 square metres
of gross floor area, 3 spaces for the next 50 square metres of gross floor area
over 150 square metres and 10 spaces per 100 square metres of gross floor
area over 200 square metres) for restaurant use on the ground floor.

c) To permit 8 parking spaces (1 space for the first 50 square metres of gross floor

area plus 3.5 spaces per 100 square metres of gross floor area over 50 square
metres) for restaurant use on the upper level whereas the By-law requires a
minimum of 24 parking spaces (3 spaces for the first 50 square metres of gross
floor area plus 10 spaces per 100 square metres of gross floor area over 50


square metres) for restaurant use not located on the ground floor.
d) To permit 1 parking space (0.8 spaces per 100 square metres of gross floor

area) for personal service business use (hair salon) on the upper level whereas
the By-law requires a minimum of 2 parking spaces (2.5 spaces per 100 square
metres of gross floor area) for personal service business use not located on the
ground floor.

e) To permit 1 parking space (0.8 spaces per 100 square metres of gross floor

area) for retail use on the upper level whereas the By-law requires a minimum of
2 parking spaces (2.5 spaces per 100 square metres of gross floor area) for retail
use not located on the ground floor.

THE APPLICATION indicates that four of the thirteen parking spaces for the subject
property have been addressed through a Cash-in-Lieu parking agreement in May 2001
and that the Property is not the subject of any other current application under the
Planning Act.
