PURPOSE OF THE APPLICATION:
The Owner wants to construct a four-storey, mixed-use medical/office building, as
shown on plan filed with the Committee. A surface parking lot will be provided for the
proposed building on the east side of the property as well as 6 underground parking
spaces, as shown on plans filed with the Committee.
RELIEF REQUIRED:
In order to proceed, the Owner requires the Authority of the Committee for Minor
Variances from the Zoning By-law as follows:
a) To permit a total of 20 parking spaces (17 spaces for the medical use based on 2.8
spaces per 100 square metres of gross floor area and 3 spaces for the office use
based on 1.0 spaces per 100 square metres of gross floor area) whereas the By-law
requires a minimum of 31 parking spaces, 4 spaces per 100 square metres of gross
floor area for the 612 square metre medical use and 2 spaces per 100 square
metres for the 289 square metre office use.
b) To permit a reduced driveway widths of 6.2 metres for two separate driveways
whereas the By-law requires a minimum driveway width of 6.7 metres for a double
traffic lane.
c) To permit one parking space to be located in a corner side yard (Collins Avenue) of
the proposed building whereas the By-law does not permit parking in a required
corner side yard.
d) To permit the parking space outlined in variance (c) above to also be used as
loading space measuring 3.5 m x 5.2 m x 2.7 m high whereas the By-law requires a
minimum loading space width of 3.5 metres, a minimum length of 9.0 metres and a
minimum vertical clearance of 4.2 metres.


e) To permit the exterior garbage and recycling enclosure to be located 0.5 metres of
the northerly lot line whereas the By-law states, in part, that all loading and refuse
collection areas contained within a parking lot must be located at least 3.0 metres
from any other lot line.
f) To permit a reduced easterly landscaped buffer width of 1.5 metres for the parking
lot containing 14 parking spaces abutting a residential zone whereas the By-law
requires a minimum landscaped buffer width of 3.0 metres for a parking lot
containing more than 10 but less than 100 spaces abutting a residential zone.
g) To permit a reduced northerly landscaped buffer width of 0.5 metres for a parking lot
containing 14 parking spaces not abutting a public street whereas the By-law
requires a minimum landscaped buffer width of 1.5 metres for a parking lot
containing more than 10 but less than 100 parking spaces not abutting a street.
It should be noted, that for By-law purposes, Bank Street is deemed to be the front lot
line for this property.
THE APPLICATION indicates that the Property is the subject of a current Site Plan
Control Application (D07-12-15-0124) under the Planning Act.
