PURPOSE OF THE APPLICATION:
The Owners want to construct a 1.1 m x 3.6 m staircase which will connect the main
level deck at the rear of their detached dwelling to the ground, as shown on plans filed
with the Committee.
RELIEF REQUIRED:
In order to proceed, the Owners require the Authority of the Committee for a Minor
Variance from the Zoning By-law to permit a permitted projection (stairway) to project
4.46 metres into the required rear yard whereas the By-law permits a maximum
permitted projection of 1.5 metres into a required yard, but not closer than 1 metre to a
lot line.
It should be noted that permitted projections are to be measured from the required yard
setbacks. In this case, a portion of the existing dwelling and deck already extend into
the required rear yard setback.
THE APPLICATION indicates that the Property is not the subject of any other current
application under the Planning Act.
