PURPOSE OF THE APPLICATIONS:
The Owner has filed Consent Applications (D08-01-15/B-00263 to D08-01-15/B-00265)
which, if approved, will have the effect of creating three separate parcels of land. It is
proposed to demolish the existing dwelling and shed and construct a three-storey
detached dwelling on one parcel, and a three-storey semi-detached dwelling on the
other two parcels, with one dwelling unit on each of the parcels, as shown on plans filed
with the Committee. The application indicates that the proposed semi-detached dwelling
will have secondary dwelling units located in the basement.
RELIEF REQUIRED:
In order to proceed, the Owner requires the Authority of the Committee for Minor
Variances from the Zoning By-law as follows:
A-00256: 375 Dominion Ave., Parts 1 & 2 on Draft 4R Plan - proposed detached
dwelling
a) To permit a reduced lot width of 7.61 metres whereas the By-law requires a
minimum lot width of 9.0 metres.
b) To permit a reduced lot area of 158 square metres whereas the By-law requires
a minimum lot area of 270 square metres.
c) To permit an increase in building height to 10.0 metres whereas the By-law
permits a maximum building height of 8.0 metres.
d) To permit a reduced rear yard setback of 23.4% of the lot depth, or 4.9 metres
and a reduced rear yard area of 23.4% of the lot area, or 37.2 square metres
whereas the By-law requires a minimum rear yard setback of 25% of the lot
depth, or in this case, 5.2 metres and a minimum rear yard area of 25% of the lot
area, or in this case, 37.2 square metres.


e) To permit a reduced total interior side yard setback of 0.9 metres with yards of
0.6 metres (south) and 0.3 metres (north) whereas the By-law requires a
minimum total interior side yard setback of 1.8 metres, with no yard less than 0.6
metres wide.
f) To permit a reduced front yard setback of 2.74 metres whereas the By-law states
that the minimum front yard setback on an interior lot must be the average of the
existing setbacks of the abutting lots on which the dwellings face the same street
as the affected lot which, is this case, is 2.8 metres.

g) To permit a reduced lot width of 4.74 metres whereas the By-law requires a
minimum lot width of 5.6 metres.
h) To permit a reduced lot area of 98 square metres whereas the By-law requires a
minimum lot area of 165 square metres.
i) To permit an increase in building height to 10.0 metres whereas the By-law
permits a maximum building height of 8.0 metres.
j) To permit a reduced northerly interior side yard setback of 0.6 metres whereas
the By-law requires a minimum interior side yard setback of 1.2 metres
k) To permit a reduced front yard setback of 2.74 metres whereas the By-law states
that the minimum front yard setback on an interior lot must be the average of the
existing setbacks of the abutting lots on which the dwellings face the same street
as the affected lot which, is this case, is 2.8 metres.
