PURPOSE OF THE APPLICATIONS:
The Owners have filed Consent Applications (D08-01-15/B-00246 to D08-01-15/B00249) which, if approved, will have the effect of creating four separate parcels of land.
The Owners want to demolish the existing dwelling and garage located on the property
and construct two, three-storey semi-detached dwellings, as shown on plans filed with
the Committee.
RELIEF REQUIRED:
In order to proceed, the Owners require the Authority of the Committee for Minor
Variances from the Zoning By-law as follows:
A-00240: 298 Byron Avenue, Part 1 on Draft 4R Plan - One half of a proposed semidetached dwelling
a) To permit a reduced lot width of 6.80 metres whereas the By-law requires a
minimum lot width of 7.5 metres.
b) To permit a reduced lot area of 141.9 square metres whereas the By-law
requires a minimum lot area of 225 square metres.
c) To permit an increase in building height to 9.68 metres whereas the By-law
permits a maximum building height of 8.0 metres.
d) To permit a reduced rear yard setback of 21% of the lot depth, or 4.39 metres
and a reduced rear yard area of 21% of the lot area, or 30.15 square metres
whereas the By-law requires a minimum rear yard setback of 25% of the lot
depth, or in this case, 5.18 metres and a minimum rear yard area of 25% of the
lot area, or in this case, 35.47 square metres.
e) To permit a reduced front yard setback of 4.01 metres whereas the By-law states
that the minimum required yard setback for a yard abutting a street must be, on a
corner lot, the front yard setback of the abutting residential lot that faces the
same street as the affected lot, in this case, 6.73 metres.

minimum lot width of 7.5 metres.
g) To permit a reduced lot area of 142.0 square metres whereas the By-law
requires a minimum lot area of 225 square metres.
h) To permit an increase in building height to 9.68 metres whereas the By-law
permits a maximum building height of 8.0 metres.
i) To permit a reduced rear yard setback of 24% of the lot depth, or 5.00 metres
and a reduced rear yard area of 23.9% of the lot area, or 34.05 square metres
whereas the By-law requires a minimum rear yard setback of 25% of the lot
depth, or in this case, 5.21 metres and a minimum rear yard area of 25% of the
lot area, or in this case, 35.5 square metres.
j) To permit a reduced front yard setback of 4.01 metres whereas the By-law states
that the minimum required yard setback for a yard abutting a street must be, on a
corner lot, the front yard setback of the abutting residential lot that faces the
same street as the affected lot, in this case, 6.73 metres.
