PURPOSE OF THE APPLICATION:
The Owner wants to establish a 3.048 metre x 18.847 metre outdoor patio along the
south side of its building in front of Cooper’s Grill, as shown on plans filed with the
Committee. The application indicates that the patio will seat a maximum of 48 people.
In order to proceed, the Owner requires the Authority of the Committee for Minor
Variances from the Zoning By-law as follows:
a) To permit an outdoor patio to be located 0 metres from a residential zone
whereas the By-law states, in part, that an outdoor commercial patio is prohibited
in any yard facing or abutting a residential zone, or abutting a yard or lane facing
or abutting a residential zone, unless it is located a minimum of 30 metres from
the residential zone.
b) To permit no screening or physical separation of the patio from the residential
zone whereas the By-law prohibits, any outdoor commercial patio facing or
abutting a residential zone, or abutting a yard or lane facing or abutting a
residential zone, unless it is screened and physically separated from the
residential zone by a building, structure, fence or wall that is at least 2 metres in
height so as to mitigate both light and noise from the outdoor commercial patio.
THE APPLICATION indicates that the Property is not the subject of any other current
application under the Planning Act.
