PURPOSE OF THE APPLICATION:
The Owner wants to demolish the existing building and construct a six-storey mixed-use
building, as shown on plans filed with the Committee. The property is subject to two
different zoning designations as well as the Heritage Overlay Provisions of the Zoning Bylaw. The east side of the property is zoned TM H(19) and the west side is zoned R5B[482]
H(37).
RELIEF REQUIRED:
In order to proceed, the Owner requires the Authority of the Committee for Minor Variances
from the Zoning By-law as follows:
Under the TM H(19) Zone:
a) To permit an increase in building height to 22 metres whereas the By-law permits a
maximum building height of 20 metres but not more that 6-storeys, except where
otherwise shown on the zoning map. In this case, the zoning map reflects a
maximum height of 19 metres.
b) To permit a reduced corner side yard setback (Lisgar Street) of 1.7 metres for that
part of the building below 15 metres in height, and a reduced setback of 3.7 metres
for the portion of the building above 15 metres in height whereas the By-law
requires a minimum corner side yard setback of 3 metres except for any part of a
building above 15 metres for which an additional 2 metre setback must be provided.
Under the R5B[482] H(37) Zone:
c) To permit a reduced easterly rear yard setback of .91% of the lot depth, or 0.038
metres whereas the By-law requires a minimum rear yard setback of 25% of the lot
depth, but need not exceed 7.5 metres. In this case, the requirement is 7.5 metres.
d) To permit a reduced corner side yard setback (Lisgar Street) of 1.7 metres whereas
the By-law requires a minimum corner side yard setback of 3 metres.


e) To permit a reduced southerly interior side yard setback of 3 metres whereas the
By-law requires a minimum interior side yard setback of 6 metres for any part of a
building located further than 21 metres from the front lot line.
THE APPLICATION indicates that the Property is the subject of Site Plan Control
Application (D07-12-14-0107) under the Planning Act.
